LIABILITY WAIVER AND RELEASE OF CLAIMS
Please read this document carefully. By participating in horse boarding, equine therapy, horse clinics, or team building activities at Lucky Horseshoe Ranch, you are giving up certain legal rights, including the right to sue for damages in the event of injury or death.
1. NATURE OF EQUINE ACTIVITIES
The participant understands that horse boarding, equine therapy, horse clinics, and team building activities are inherently dangerous. Horses are large, unpredictable animals that may react suddenly to sound, movement, objects, or other animals. Risks include, but are not limited to: collisions, falls, kicks, bites, and unpredictable terrain.
2. ASSUMPTION OF RISK
I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation (or that of my minor child).
3. RELEASE OF LIABILITY
I, for myself and on behalf of my heirs, assigns, and next of kin, hereby release and hold harmless Lucky Horseshoe Ranch, its officers, employees, and owners (the 'Releasees'), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise.
4. INDEMNIFICATION
I agree to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in horse boarding, equine therapy, horse clinics, or team building activities.
5. MEDICAL AUTHORIZATION
In the event of an emergency, I authorize Lucky Horseshoe Ranch to secure medical treatment for myself or my child, including transportation to the nearest medical facility, and I agree to bear all costs associated with such treatment.
6. PROTECTIVE HEADGEAR REQUIREMENT
I understand that Lucky Horseshoe Ranch requires all riders to wear ASTM-standard / SEI-certified protective headgear while mounted. Failure to do so is at the participant's own extreme risk and may result in immediate dismissal from horse boarding, equine therapy, horse clinics, or team building activities.
7. ALCOHOL AND DRUG PROHIBITION
The use of alcohol or controlled substances is strictly prohibited on ranch grounds. Participants suspected of being under the influence will be prohibited from riding or handling horses for the safety of all parties.
8. ADHERENCE TO RULES AND INSTRUCTIONS
I agree to obey all ranch rules and follow the instructions given by trainers, guides, and staff. Failure to comply with safety protocols constitutes a material breach of this agreement.
9. GOVERNING LAW AND SEVERABILITY
This agreement shall be governed by and construed under the laws of the jurisdiction in which the ranch operates. If any portion of this agreement is held invalid, the remainder shall continue in full legal force and effect.
10. ACKNOWLEDGMENT OF UNDERSTANDING
I have read this waiver of liability and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
IMPORTANT: By signing below, you acknowledge that you have read and understood this Agreement and that you are voluntarily giving up certain legal rights, including the right to sue Lucky Horseshoe Ranch.
